Silvertree offers a wearable wellness device that provides advanced safety and wellness features, such as one-touch emergency notifications and fall detection, for active older adults (“Users”) . Through the GPS-enabled device and the related app, Users can send alerts to and otherwise communicate with their loved ones and trusted care providers (“Care Team”).
This Privacy Policy describes how we handle the personal information we collect in connection with our website, apps, and related services (collectively, the “Services”). Unless specified below, “you” refers to Users, Care Team members, website visitors, and anyone else who uses our Services.

Personal Information We Collect

We collect the following categories of information

Information provided by Users:

  • Contact details, such as your name, phone number, and email and mailing address.
  • Precise geolocation information, including 24/7 real-time GPS tracking, that we collect in order to provide our Services.
  • Medical information that you may choose to add to your profile on the app, such as health records (allergies, medications, and medical devices) or insurance information.
  • Payment information needed to complete your purchase of the Silvertree Reach product on the website (including name, payment card information, billing information), and your transaction history. Payment information is processed by our third-party payment processor Stripe, in accordance with Stripe’s privacy policy and terms of service. We do not have access to payment card numbers.
  • Communications that we exchange with you, including when you contact us with questions, feedback, or otherwise.
  • Marketing information such as your preferences for receiving communications about our Services and publications, and details about how you engage with our communications.

Information provided by Care Team:

  • Contact details, such as your name, phone number, and email and mailing address.
  • Communications that we exchange with you, including when you contact us with questions, feedback, or otherwise.
  • Marketing information, such as your preferences for receiving communications about our Services and publications, and details about how you engage with our communications.

Information we obtain from other sources:

  • Social media information. We may maintain pages on social media platforms, such as LinkedIn. When you visit or interact with our pages on those platforms, you or the platforms may provide us with information through the platform.
  • Third-party logins. When you link, connect, or login to the Services with a third party service (e.g. Auth0), you direct the service to send us information as controlled by that service or as authorized by you via your privacy settings at that service.

Automatic data collection. We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, such as:

  • Device data, such as your computer’s or mobile device’s operating system, manufacturer and model, browser type, IP address, unique identifiers, language settings, mobile device carrier, and general location information such as city, state or geographic area; and
  • Usage data, such as pages or screens you viewed, how long you spent on a page, browsing history, and access times.
We may collect this information using cookies and other similar technologies. Cookies are text files that websites store on a visitor‘s device or in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping us understand user activity and patterns. How We Use Personal Information

We use personal information for the following purposes:

To provide the Services. This includes:

  • Providing Care Team members with notifications about falls or other emergencies (Users need to enable notifications on their mobile device to operate this feature);
  • Enabling Users and Care Team members to create an account on our app;
  • Administering, hosting, and operating the Services;
  • Communicating with you and responding to any inquiries you may have; and
  • Analyzing your use of the Services to allow us to evaluate and improve the Services.
Research, development, benchmarking, and improving our Services. We may use personal information to analyze and improve the Services, identify trends, and operate and expand our business activities. We may also create aggregated, anonymized, or other de-identified statistics, which we may use for lawful business purposes, including for analytics, forecasting, and strategic planning.

Marketing and advertising, including for:

  • Direct marketing. We may send direct marketing communications, including, but not limited to, sending newsletters or publications, and notifying you of promotions, offers and events via postal mail, email, telephone, text message, and other means.
  • Interest-based advertising. We engage our advertising partners, including third party advertising companies and social media companies, to advertise our Services. For more information, or to understand your choices, please visit the Your Privacy Rights and Choices section below.
For compliance and protection, including to enforce any applicable terms and conditions, comply with legal obligations, defend against legal claims or disputes, protect the security and integrity of our Services, and identify and investigate fraudulent, harmful, unauthorized, unethical or illegal activity.

How We Share Personal Information

We do not sell personal information. We may share personal information with:

Care Team. We may share a User’s personal information with the User’s designated Care Team at the User’s direction, including the User’s location, fall reports or other emergency notifications, and any other information that the User has uploaded to the app. A User can stop sharing information with a Care Team member at any time by deleting that member of their Care Team on the app.

First responders. With the User’s permission, we may share a User’s personal information with first responders in the event of an emergency, including the User’s location, health records, and any other information that the User has uploaded to the app.

Emergency dispatch services. In the event a User’s Care Team is unable to respond to an emergency, the app will escalate a User’s fall report or other emergency notification to emergency dispatch services, who will receive a User’s location, address, and Care Team information.

Service providers. We share personal information with companies and individuals that provide services on our behalf or help us operate our Services or our business (such as hosting services, communications, data and cyber security services, billing and payment processing services, fraud detection, investigation and prevention services, web and mobile analytics, email and communication distribution and monitoring services, and customer relation management systems).

Advertising partners. We may share personal information that we collect on our website with third party advertising companies (including for the interest-based advertising purposes described above), lead generation partners, and channel partners, resellers, and distributors that allow us to explore and pursue growth opportunities.

Professional advisors. We share personal information with professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others. We may share personal information with law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate.

Business transferees. We may share personal information with acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Silvertree or our affiliates (including, in connection with a bankruptcy or similar proceedings).

How We Protect Sensitive Personal Information

Users’ medical information. If you choose to provide medical information through the app, we maintain that information on your behalf so that it is available to the Care Team and first responders in the event of an emergency. For example:

  • Users can add information about their allergies and health conditions to enable their Care Team and first responders to provide appropriate treatment; and
  • Users can add their health insurance information to allow their Care Team and first responders to identify and bill their insurance provider when providing care.

You are not required to provide your medical information in order to use the Services. You can edit or remove your medical information at any time within the app.

Users’ precise geolocation. Our Services feature 24/7 precise location tracking to allow Care Team members to check in on you and monitor your location, and to allow first responders to locate you in the event of an emergency.

  • When you use the Services, your location will be visible to all members of your Care Team at all times. If you do not wish to share your location with any member of the Care Team, you can remove that member from their Care Team at any time within the app.
  • When you send an alert to members of your Care Team, we may share your location with emergency dispatch services and first responders to allow them to locate you, respond to the alert, and provide you with the care you need.

Location tracking is a core feature of the Services and cannot be disabled. If you decline to grant access to your location, you will not be able to use the Services.

We do not sell or share medical or precise geolocation information with our advertising partners, nor do we use this information for interest-based advertising purposes.

Your Privacy Rights and Choices

Unsubscribe from direct marketing communications. You may opt out of marketing-related communications by following the opt out or unsubscribe instructions contained in the marketing communication we send you. You may continue to receive service-related and other non-marketing communications.

Opt-out of push notifications. If you opt in to receive push notifications within the app, we may send push notifications or alerts to your mobile device from time to time. You can deactivate push notifications and alerts at any time by changing your device settings, changing the push notification settings within the application, or deleting the app.

Privacy rights. Depending where you reside, you may have the following rights:

  • Information. You may have the right to obtain information about how we collect, use, and share your personal information. We provide this information within this Privacy Policy.
  • Access, correction and deletion. You may also have the right to request access to your personal information, to correct personal information that is out of date or inaccurate, or to delete personal information that is no longer needed for a permitted purpose. Where these rights apply, you are entitled to exercise these rights free from discrimination.
  • Sharing personal information and targeted advertising. We do not sell, or share for targeted advertising purposes (“share”), any personal information we collect from you through the Reach product or the app, including your precise location or medical information. However, we use cookies on our website to help us advertise our Services on other websites you might visit. We may share information we collect via our website, such as information about the pages you visit on our website and your purchases, with our advertising and channel partners to support our interest-based advertising, which may qualify as a sale or sharing of personal information, or targeted advertising, under applicable law. You can opt-out of our use of sharing of personal information for these purposes as described in the Opt-out of interest-based advertising section below or by clicking Your Privacy Choices on the footer of our website.

Limitations. Your rights may be limited under applicable laws, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights.

Opt-out of interest-based advertising. You may limit online tracking by:

  • Blocking cookies in your browser. Most browsers let you remove or reject third-party cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.   • Blocking advertising ID use in your mobile settings. Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.
  • Using privacy plug-ins or browsers. You can block our websites from setting cookies used for interest-based ads by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third party cookies/trackers. Note that because these opt out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Data Security

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe and we cannot guarantee the security of your personal information.

Data Retention

We may retain your personal data for as long as it is reasonably needed in order to maintain and expand our relationship and provide you with our Services; in order to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of such data, the potential risk of harm from unauthorized use or disclosure of such data, the purposes for which we process it, and the applicable legal requirements.

Children

Our Services are not intended for use by children without the consent of their parents or guardians. If we learn that we have collected personal information through our Services from a child under 13 without the consent of the child’s parent or guardian as required by law, we will delete it.

Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy. We may also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail (if you have an account where we have your contact information) or another manner.
